TERms of service for custom work

I reserve the right to refuse any commission for any reason.

• all work prohibited from being used as NFTs
•  I will not create content that promotes racism, homophobia, sexism, etc.
• I will not create content of incest, pedophilia, or fetish content 
• I do not offer NSFW work, suit, plush, art or otherwise
• I will not include religious or satanic symbols for sake of aestetic
• I do not draw ship art of any kind
• I do not work on fursuit head bases that are not my own creation 
• I do not offer moving jaw fursuit heads

1. I reserve the right to refuse a commission for any reason, and refund a commission at any point in time during the commission process.
2.  I reserve the right to alter my TOS at any time
3.  I reserve the right to utilize any completed art for portfolio purposes and examples of my work, as well as post them to my social media (you will be tagged in these posts as the owner of any characters with whatever social media you have or prefer)
4.  While I can work off of a total artistic liberty posing or off of a simple descriptor (ie, happy or sad), if you do not like how the piece came out or had something else in mind, there will be a fee to resketch the entire project.
5.  Likewise, if you want to see several rough posing options on something artistic liberty, please let me know in advance- I usually don't charge more to do 3 to 4 of them, but if you don't like any, you must pay for additional drafts. This does not apply to icons or telegram stickers.
6.  I do not send the PSD/Layered document that I work on unless explicitly requested before the commission is started. This will incur an additional fee.
7. My art cannot be used for profit or manufactured into a physical product unless explicitly discussed with me beforehand.
8.  I require a royalty fee for distribution of my art if a profit is being made.
9.  I do not allow for my art to be edited by anyone other than myself- I am happy to fix your piece (within reason) if there is anything I missed.
10.  During the commission process, I will send a sketch for approval, flat colors (if applicable), and then the finished product. If you would like to see more progress shots of your work, please let me know before the commission is started.6a) Once a commission is confirmed and payment is received, the subject and commission type cannot be changed, upgraded or downgraded.
11.  I offer 2 free edits during the lifetime of the pieces creation:
    1 edit counts as either 2-3 small changes that are needed (expression, hand position, color issue)
    or one large one (re sketching clothes, recoloring markings).
12.  Once a piece has been approved in its stage (ie, you approve a sketch), I am not obligated to accept edits on that part of the piece- if the piece is finished and you’d like something changed that could have been addressed at the sketch and/or lineart phases, there will be a fee.
13. I do not allow clients to edit works in progress to indicate changes unless the client requests permission and I approve it, case by case.
14. Once 21 days (3 weeks) has passed since the completion and approval of a final piece, I will not be making edits to a commission, period (up until this time, I can accept edits with a fee). You are still not allowed to edit the piece yourself.
15. If a piece has not been approved within 14 days of the sketch wip being sent, the piece will be automatically considered approved and will be completed.
16.  I do not allow for my art to be used in any Cryptocurrency of any time, at all. 

1.  When purchasing a design (Custom or premade), the buyer retains any character rights to the design. It can be used for, physical merchandise or any other forms of profit so long as the buyer creates their own art of the character.
2.  With this in mind, the only thing I request you do NOT do with my design work is use it to promote racism, homophobia, transphobia, ableism, or anything else encouraging or supporting extremist or bigoted beliefs. I also do not allow them to be used for NFTs (Non Fungible Tokens). I do not want said content associated with my work or professional brand.
3. While the character does belong entirely to the buyer, I reserve the right to use the character in portfolios/ social media as examples of my past work. The buyer will be credited with ownership.

I provide work in progress photographs along the way, whenever requested. I typically send one per day of work, to show what I have done for the day. Be vocal about changes you'd like done on your work, as soon as noticed. Large edits caught late in the process are subject to editing fees.

At this time I do not offer deadlines for my suit, art, or plush work, but turnaround is typically six months or less.

I work Monday - Thursday, 9am-5pm. I may or may not respond to messages outside of those hours.

Payment is taken for large projects (over $300 dollars) via custom listings on site.

40% of payment is nonrefundable to cover material costs. 

Payment in full is required. 

A tax rate of 2.9% is applied to commissions per Colorado state sales tax.

Payment plans are not accepted through me. Options for extended payment are as follows:

-Since we use a custom listing on our website, this allows you to pay via a credit card, so you can pay off your project on your own timeline. 

Shipping will be calculated when the project is completed, and project will be shipped when shipping is paid. Shipping is paid via Paypal invoice.

All payment is processed via invoices sent to a commissioners email or via website storefront.

Payment is required up front and before progress is started on the commission, If 3 days pass without payment, the commission will be cancelled.

At this time, refunds are only available if a project has not been started, and a partial refund if the project is somewhat completed. If a refund is requested, the client will be blacklisted from services for the foreseeable future once the refund is processed. Please be aware of this when ordering!

 Commissions have up to a 6 month turnaround time, depending on what was ordered.

 Attempted chargebacks on a completed commission will result in a permanent refusal of service.
 

 All references sent to me MUST be SFW. I will not accept any NSFW references. Sending me an NSFW reference will get you blacklisted. The clearer the reference the better, and multiple angles are great as well. 

 HappyFoxx Creations suits/plush/kigurumi have a 60-day-free-repair warranty. This covers anything that happened during shipping, loose or popped seams, loose parts. If the client find problems, it is their responsibility to contact HappyFoxx Creations to return the suit/plush/kigurumi for free repairs. This does not cover intentional damages. If it is not sent in for repair before the 60-day warranty ends, client will be charged for repairs. Damaging or altering the suit voids the warranty. 

HappyFoxx Creations custom plush are hand made. It is appropriate for gentle cuddling. They are not for hard play, including sleeping with them. Spot clean/handwash only, avoiding any airbrushing or rhinestone work. 

Once product is in your possession it is your responsibility. 

 Shipping costs are the responsibility of the client! If you do not pay your shipping your will be blacklisted from shopping with us again!
